Supreme Court orders Nepal government to explain failure in controlling online gambling

The Supreme Court has issued an order asking the government to explain why it has failed to control online gambling and betting activities.

The order came after an initial hearing of a writ petition filed by law students Subas Prasad Sah, Nisha Yadav, and Aarti Kumari Yadav. Justice Nityanand Pandey’s bench said that online betting is operating freely, and the government must provide an explanation.

Under Section 125 of the Muluki Criminal Code, gambling and betting are considered crimes. The petitioners said online platforms are allowing gambling without restriction and asked the court to issue orders to stop it.

They also stated that agencies like the Advertising Board, Nepal Telecommunications Authority, and Cyber Bureau have taken no steps to control online gambling, and social media platforms like Facebook Reels, TikTok, and Instagram are misleading users into criminal activities.

While the court refused to issue an immediate interim order, it instructed the government to submit a report explaining why online gambling has not been controlled. The court also ordered that the case be given priority.

The petitioners argued that online betting and gambling encourage ordinary people to commit crimes and filed the case against the responsible agencies to take action.
